Washington, DC (WorkersCompensation.com) – Firefighters covered under the Federal Employee Compensation Act would be entitled to coverage if they develop cancer deemed a consequence of employment. The Federal Firefighters Fairness Act of 2019 would create a presumption that 14 types of the disease are occupational for federal firefighters. That presumption could be disputed by a preponderance of the evidence standard.
Sen. Susan Collins, D-ME, said in a statement that 42 states have similar laws on the books, but that the federal government gives firefighters “the “difficult burden of proving the precise exposure and conditions that led to their illness.”
Collins and Sen. Tom Carper, D-DE, introduced the proposal, as similar legislation was introduced in the House.
