The charges are felonies carrying a maximum possible sentence totaling 25 years in prison.
According to the arrest warrant affidavit, Mr. Guirguis reported a work-related injury in June 2004 while employed as a food service manager for the Wild Oats Market in Westport. Between 2004 and 2009 he received $168,935 in temporary and total disability benefits and an additional $69,148 in medical benefits, the warrant states.
The warrant alleges that while collecting benefits, Mr. Guirguis ran a bulk-mailing company in New Britain and was observed moving and working in direct contradiction to the abilities he claimed during medical examinations.
The warrant also alleges that Mr. Guirguis was untruthful during a deposition taken under oath regarding his employment history.
The charges are merely accusations and the defendant is presumed innocent until and unless proven guilty.
Mr. Guirguis was arrested by Inspectors from the Workers' Compensation Fraud Control Bureau in the Office of the Chief State's Attorney. He was released on a promise to appear September 10, 2010, in New Britain Superior Court, G.A. No. 15.
The case is being prosecuted by the Workers' Compensation Fraud Control Bureau in the Office of the Chief State's Attorney.
