TX WCC Adopts Amendments Of Review Of Employer Report Of Injury

                               
Dallas, TX (CompNewsNetwork) - The Commissioner of Workers' Compensation Rod Bordelon adopted amendments to 28 Texas Administrative Code (TAC) §136.1 and §136.2 regarding Review of Employer Report of Injury and Registry of Private Providers of Vocational Rehabilitation Services. The adoption was filed with the Office of the Secretary of State on January 14, 2011. 
 
The purpose of the adoption is to add Licensed Master Social Workers and Licensed Clinical Social Workers to the list of acceptable credentials to be on the Texas Department of Insurance, Division of Workers' Compensation (TDI-DWC) Registry of Private Providers of Vocational Rehabilitation Services (Registry). The amendments will provide for a broader selection of vocational rehabilitation providers and greater geographic coverage of services.
 
An applicant for the Registry must file a DWC Form-065, Private Providers of Vocational Rehabilitation Services, with the TDI-DWC. Each application will be evaluated on a case-by-case basis to ensure the applicant meets the requirements of 28 TAC §136.2. Admission to the Registry, however, is not a guarantee of receiving business as insurance carriers independently employee the providers of their choosing that deliver vocational rehabilitation services to injured employees.
 
The DWC Form-065 is being revised to conform with the adopted rules. The finalized form will be made available at a later date.
 
The adoptions are effective February 3, 2011.
