Texas Drafts Informal Version Of Rules Relating To The Medical Quality Review Panel And Draft Medical Quality Review Process

                               

Austin, TX (WorkersCompensation.com) - The Texas Department of Insurance, Division of Workers' Compensation (TDI-DWC) is
accepting comment on informally proposed rules to add new 28 Texas Administrative Code
(TAC) §§180.60 - 180.78. The purpose of this informal working draft is to request input from
workers' compensation system participants regarding the formulation of rules that would
implement Texas Labor Code §§413.0512, 413.05121 and 413.05122, which were enacted or
amended by House Bill 2605 by the 82nd Legislature, Regular Session, effective September 1,
2011. The informally proposed rules incorporate many of the same requirements as the Texas
Medical Board.

The draft addresses the role of the Medical Quality Review Panel (MQRP), the process to
become a member of the MQRP, the medical quality review process, training, conflicts of
interest and rights and responsibilities of persons involved in the medical quality review process.
The informal working draft was published on May 7, 2012 and may be viewed on the TDI
website at http://www.tdi.texas.gov/wc/rules/drafts.html. The comment period on the informal
proposal closes June 6, 2012 at 5 p.m. Central Standard Time.

This informal working draft is not a formal rule proposal. Accordingly, comments will not be
treated as formal public comment for the purposes of the Texas Administrative Procedure Act.
In addition to commenting on this informal proposal, there will be the opportunity to formally
comment once the rules are proposed and published in the Texas Register. The TDI-DWC
anticipates formal publication of the rules in July 2012. The informal working draft may contain
drafting notes and formatting which will be changed as necessary to comply with the Texas
Register formatting.
