OH: Licking County Business Owner to Pay Back BWC $100k

Columbus, OH (WorkersCompensation.com) - Thomas Tomson was found guilty on one count of workers’ compensation fraud, a third-degree felony, and one count of workers’ compensation fraud, a fourth-degree felony, and must pay back $100,000 to the Bureau of Workers’ Compensation (BWC). BWC’s Special Investigations Department opened an investigation after its Intelligence Unit identified Thomas Tomson may own a company while in receipt of permanent total disability (PTD) benefits.

The investigation found Tomson started a new business, Bulldog Services, where he worked and received income from this business while in receipt of PTD benefits. Bulldog Services was later sold and operated under the name of Kirk’s Business with which Tomson continued to work. Both businesses provided the same services as the employer of record for Tomson’s BWC claims, T.H.E. Contracting, which was also owned by Tomson.

On February 22, 2022, a jury trial in Licking County began and on February 24, 2022, the jury found Thomas Tomson guilty on one count of workers’ compensation fraud, a third-degree felony, and one count of workers’ compensation fraud, a fourth-degree felony.

On April 11, 2022, Licking County Judge David Branstool sentenced Tomson to two years of probation and ordered Tomson to pay $100,000 in restitution to the Ohio Bureau of Workers’ Compensation.
