NYSWCB Draft MAP Forms And Decisions For Review

                               

New York City, NY (CompNewsNetwork) - The New York State Workers' Compensation Board has been engaged in a project to study and improve the administration of the Conciliation process. The project known as the Managed Adjudication Path or MAP, will introduce a series of administrative changes to improve the handling and resolution of claims at the Board.

On May 7, 2010, an educational event was held, designed to inform stakeholders in the workers' compensation system about the MAP program and elicit feedback.

The Board continues to solicit input for the proposed program.

Proposed Forms

The WRFA-1 draft titled "Injured Worker's Request For Assistance" is designed solely for the Injured Worker to use when they are seeking the Board's assistance.

The ARFA-1 draft titled "Attorney/Representative's Request For Further Action" is designed solely for the Attorney/Representative, who on behalf of the injured worker they are representing, is seeking further action from the Board.

The RFA-2 draft titled "Carrier's/Employer's Request For Further Action" is intended for the carrier or self insured employer to use when they are seeking further action from the Board.

The EC-81.7 draft titled "Notice Regarding Possible Award for Permanent Injury" is an outreach tool containing drafts of letters that were crafted with a user friendly focus and which would be used when the Board has information regarding permanency for schedule loss of use cases. The EC-81.7 includes four checkbox options that generate easy to read letters to the appropriate parties of interest, including unrepresented claimants. All letters will contain the heading "Notice Regarding Possible Award for Permanent Injury" to catch the recipient's attention.

Proposed Decisions

PD - Proposed Decision for all proposed decisions except those involving Schedule Loss of Use

PD SL - Proposed Decisions for Schedule Loss of Use cases where there is no conflicting medical opinion and the claimant was over the age of 25 at the time of injury

PD Cancel - Cancelled Proposed Decisions

5 Language Attachment - Attachment to Claimant's copy of the PD notice (Additional information for claimants with limited English, or who speak Spanish, Polish, Russian or Mandarin Chinese)
