New York, NY (CompNewsNetwork) - A Herkimer County man who collected workers' compensation benefits while working at a Utica bar was sentenced Wednesday to 90 days in jail and five years probation.
David A. Bower, 58, of Carder Lane, Frankfort, was sentenced in Oneida County Court after pleading guilty to violating the Workers' Compensation Law. He paid $3,500 in restitution at sentencing.
Bower was arrested last December following an investigation by the New York State Insurance Department's Frauds Bureau. The investigation revealed that Bower filed a work activity report declaring that he was unemployed and unable to work because of a job-related back injury while he was actually working as a disc jockey at Peepers, a bar in Utica.
The case was prosecuted by Assistant District Attorney Bernard Hyman.
