Negligence Claims Override Exclusive Remedy In Florida $16.5 Million Verdict

MIAMI, FL, March 09, 2011 /24-7PressRelease/ -- After a catastrophic construction accident left a migrant worker paralyzed and unable to remember his past, the Miami personal injury lawyers at Friedman, Rodman & Frank, P.A. secured more than $16.5 million in compensation for the victim.

Antonio Acevedo came to the United States legally in an effort to secure construction work to provide for his wife and daughter in Mexico. Upon arrival in the U.S. in 2006, Acevedo was hired to work alongside his brothers at the Opa-locka warehouse.

Despite a crumbling roof and a no-entry order by the company occupying the building, construction workers were required to work on the roof and deck of the building. While working one afternoon in the hot sun, Acevedo's life was forever altered when the deck collapsed beneath him, causing him to fall 20 feet onto the concrete floor below.

Acevedo's injuries after the fall included a fractured spine and skull, paralysis and significant memory problems. Acevedo was in a coma for three months following the construction site fall.

While this claim would ordinarily have been covered by
workers' compensation, the egregiousness of the negligence exhibited by the construction company in allowing their employees to work on a dilapidated roof and deck enabled Acevedo's attorney to file a personal injury lawsuit. Personal injury lawyer Ronald Rodman, at the law firm of Friedman, Rodman & Frank, took the case and challenged the defense's argument that they were unaware of the danger on the roof.

The jury agreed with attorney Rodman's arguments and awarded construction accident victim Acevedo more than $16.5 million for past and future damages, including lost wages and compensation for pain and suffering.

Personal injury attorney Rodman recognized the importance of this verdict for his client and other workers who may be injured on the job. "Migrant laborers are not disposable workers and worker safety still is important to jurors," he said. "Despite the workers' comp immunity changes that have been made over the years, the jury knows and can recognize when there's a bad actor."

The personal injury lawyers at Miami law firm
Friedman, Rodman & Frank, P.A. aggressively advocate for their clients. Whether the victim is injured in a car accident, a truck accident or a fatal electrocution accident, the attorneys will fight for compensation to hold the at-fault party accountable for their negligence.
