NC Man Arrested On Charges Of Failure To Pay Employee Premiums

Raleigh, NC (CompNewsNetwork) - Insurance Commissioner Wayne Goodwin today announced the arrest of Brian Joseph Eavens, 45, 4500 Central Ave. Unit C, Charlotte, on one charge of failure to pay group insurance premiums. The Charlotte-Mecklenburg Police Department assisted in the arrest.

Department investigators allege:

While working at Tavernay Services Mechanical, Eavens collected employees' health insurance premiums, but never remitted them to the health insurance company, Blue Cross and Blue Shield of North Carolina. Because of his actions, two employees and their dependents unknowingly went without health insurance for approximately one year. Eavens' failure to remit the premiums resulted in at least $14,000 worth of unpaid claims, and according to the investigation, one employee now owes $11,000 in medical bills.

Eavens was transported to the Mecklenburg County Detention Center where he appeared before a Magistrate and was released. Eavens is scheduled to appear in court on March 3. He was not the owner of Tavernay Services Mechanical, which has since closed.

The Department of Insurance employs 20 sworn law enforcement officers dedicated to investigating claims of insurance fraud. In 2008, these investigators saw more than 453 cases successfully closed with more than $5.8 million in restitution and recoveries, 60 criminal convictions and 130 arrests.
