Baton Rouge, LA - On May 26, 2010, Louisiana Governor Bobby Jindal signed House Bill 1088. The bill relates to mediations in workers compensation claims. It amends and reenacts R.S. 23:1310.3, relative to workers' compensation claims; to provide for the initiation of a claim of benefits; to proide for service of process; to provide for the filing of an answer; to provide for mediation; to provide for the running of prescription; to require mediation to encourage settlement of the case; to provide for a dispute open in excess of three hundred days; to provide for fines and other penalties when a party fails to appear; and to provide for related matters.
The law takes effect August 15, 2010.
