Illinois Workers' Compensation Commission Votes To Adopt And Submit Proposed Changes To Fee Schedule

                               

Springfield, Illinois - The Illinois Workers Compensation Commission met as a whole on September 26, 2008, and voted to adopt and submit the proposed changes to the fee schedule first voted on at the February 21, 2008 meeting. These changes create fee schedules for the following areas: ambulatory surgical treatment centers; hospital outpatient radiology, pathology and laboratory, physical medicine and rehabilitation services; hospital outpatient surgical facility services; and rehabilitation hospitals.  Due to a lack of data, the original fee schedule did not include fees for these areas, and payment was set at 76% of the provider's charge.

After February 21, 2008, the IWCC held  two hearings where public comment was taken.  Written comments were accepted until April 21, 2008. The comments were analyzed, some changes were made, and the rules were resubmitted to the Commission for approval.  Our responses to the public comments are at http://www.iwcc.il.gov/FScomments100208.pdf .

The Commission will now file the rules with the Joint Committee on Administrative Rules (JCAR), a committee of the legislature.  JCAR will conduct a 45-day review process and hold a hearing on the proposals.  It is anticipated that JCAR will vote on the rules in November.  If JCAR approves the rules, they will become effective when filed with the Secretary of State. Presently, we anticipate that will be done on December 1, 2008.

Again, the rules are not in effect now.  The Illinois Workers' Compensation Commission will announce developments as they occur.
