CA Convictions Result From Enforcement Operation For WC Insurance

Monterey, CA (CompNewsNetwork) - Monterey County District Attorney Dean D. Flippo announced today that six persons in five different cases pled to a charge of not having workers' compensation insurance for their employees in violation of Labor Code section 3700.5. The cases were filed after an enforcement operation for workers' compensation insurance on employers was conducted in Monterey County on June 22, 2010, and June 23, 2010.
James Johnston, age 62 of Carmel, Tony Mata, age 62 of Salinas, Jaime Mora, age 50 of Salinas, Danny Ngo, age 42 of Marina, Anthony Herren, age 44 of Salinas, and Jose Valencia, age 52 of Salinas, all pled to the charge of not having workers' compensation insurance for their employees. Each was placed on probation for three years, ordered to pay a fine to the Department of Insurance, Fraud Division, as well as comply with all labor laws and other standard terms of probation. Mr. Ngo and Mr. Herren were co-defendants in one case.
On June 22, 2010, and June 23, 2010, investigators from the California Department of Insurance, Morgan Hill Office, organized and led the operation with assistance from investigators of the Monterey County District Attorney Workers' Compensation Fraud Unit and from investigators from the California Department of Employment Development.
During the operation seventeen locations were checked for compliance. Seven employers were found to be in violation of the Labor Code for not securing workers' compensation insurance for their employees. Nine persons were cited, one was issued a warning, one was referred to another agency for further investigation and the remaining persons were either in compliance or did not have any employees working for them.
Employers and the public need to be aware that California State law requires that all employers secure workers' compensation insurance for their employees so that there is an assurance of adequate medical coverage and other benefits for employees for any work related injuries that may occur. Failure to secure workers' compensation insurance has a penalty of up to one year in jail and up to double the amount of the premium owed as a fine payable to the California State Treasury for the Uninsured Employers Fund. The Workers' Compensation Unit of the District Attorney's office investigates and prosecutes cases involving applicant fraud, employer fraud, premium fraud, provider fraud and employer's who do not carry workers' compensation insurance.
