CA Commissioner Announces WC Insurance Fraud Arrest

Sacramento, CA (CompNewsNetwork) - Insurance Commissioner Steve Poizner today announced that Armando Jaramillo Landa, 41, of Santa Paula, was arrested on Monday and charged with one felony count of insurance fraud. Landa was booked at the Oxnard Police Department. 

"Whether it's employers lying about how many employees they have or employees lying about their injuries, workers' compensation fraud drives up the costs of workers' compensation insurance for every employer," said Commissioner Poizner. "In this recession and in a time of record unemployment, many employers are barely making ends meet and increased workers' comp insurance costs due to fraud are the last thing they need. My team at CDI is working hard to control expenditures in the system so workers' comp insurance costs can be minimized and hopefully, jobs can be saved." 

CDI investigators determined that Landa claimed he was injured on the job while working for Chicago for Ribs in Ventura. Landa was placed on total temporary disability by his doctor, and collected more than $30,000 in disability payments from May 2007 through August 2008. While collecting total temporary disability payments, he allegedly applied for and obtained a position at Teppan Steak House in Oxnard from December 2007 through August 2008. Landa allegedly used a fictitious name, Armando De Anda, and social security number when he applied for the job. He was specifically asked if he was employed while collecting total temporary disability payments at his deposition, and allegedly denied that he had employment. 

The Ventura County District Attorney's Office is prosecuting this case.  

Commissioner Poizner oversees sixteen CDI Enforcement Branch regional offices throughout the state. Close to 1900 insurance fraud-related arrests have been made by the Department of Insurance's enforcement division since Commissioner Poizner took office in 2007 - more arrests than have been made during any other two year period, under any previous insurance commissioner.
