Businessman Charged With Failing To Provide WC Coverage

                               
Putnam, CT (CompNewsNetwork) - A Putnam man who operates businesses in Pomfret Center was arrested today and charged with failing to provide workers' compensation insurance coverage for his employees.

Russell Avery, age 67, of Woodstock Avenue, Putnam, was charged with four counts of Failure to Carry Workers' Compensation Insurance, a felony punishable by up to five years in prison for each count.

According to the arrest warrant affidavit, Mr. Avery failed to provide insurance between January 2004 and September 2008 as the president, corporate officer, manager and person in control of corporations doing business under the names of Country Springs, Inc. and Country Springs of America, LLC of 348 Orchard Hill Road, Pomfret Center.

The failure to provide insurance forced the state to pay lost wages and medical benefits to injured employees, the warrant states, and resulted in civil penalties being levied against Mr. Avery and his businesses by the State of Connecticut Workers' Compensation Commission.

Mr. Avery was released on a written promise to appear in Hartford Superior Court, G.A. No. 14, on May 8, 2009.

The charges against Mr. Avery are merely accusations, and he is presumed innocent until and unless proven guilty.

The case will be prosecuted by the Workers' Compensation Fraud Control Bureau of the Chief State's Attorney's Office in Rocky Hill.
