Here's the first question:
- Facts: A delivery app “courier” chooses hours but must accept 80% of assigned jobs, wear branded gear, and follow a scripted greeting. The company deactivates couriers who reject more than 3 jobs per shift. Courier is injured carrying a package.
- Questions: Is the courier an employee under the ABC/common law control tests? Which factor is most outcome-determinative? Does branding plus acceptance quotas tip the scale?
- Twist: Courier also uses an assistant to complete routes.
