The California Office Of Administrative Law Approves Changing Section Numbers Of Current Regulations

Oakland, CA (CompNewsNetwork) - The California Office of Administrative Law (OAL) approved the Division of Workers' Compensation's request to change section numbers of current regulations in order to accommodate new court administrator regulations, and to allow the DWC to eventually have all related rehabilitation and return to work regulations in consecutive order.

The division requested that the OAL allow it to renumber its current claim form regulations, expedited hearing regulations, and section 5814 penalty regulations. 

The division's request qualifies under Title 1, California Code of Regulations (CCR), section 100, as changes that do not materially alter any requirement, right, responsibility, condition, prescription, or other regulatory element of any provision of the CCR because the proposed changes pertain only to renumbering.

The changes are effective April 7, 2008.

The specific Title 8, California Code of Regulations sections to be amended are as follows:

Claim Form Regulations:          

Section 10116 will be Section 10136 (and reference in (b) to section 10117 will be changed to section 10139)

Section 10116.1 will be Section 10137

Section 10117.1 will be Section 10138 (and reference to section 10118.1 will be changed to section 10139)

Section 10118.1 will be Section 10139

Section 10119 will be Section 10140

Section 10120 will be Section 10141

Section 10121 will be Section 10142

Expedited Hearings:      

Section 10136 will be Section 10252 (and reference in (c) to section 10137 will be changed to section 10252.1)

Section 10137 will be Section 10252.1 (and reference to section 10136 on the form will be changed to section 10252)

Administrative Penalties Pursuant to Labor Code section 5814.6

Section 10225 will be Section 10112.1     

Section 10225.1 will be Section 10112.2 (and reference in (o) to section 10225.1 will be changed to section 10112.2)

Section 10225.2 will be Section 10112.3 (and reference in (s) to section 10225.2 will be changed to section 10112.3)
