California Division Of Workers’ Compensation Workers’ Compensation Adopts Ethics Regulations For Judges

Oakland, CA (CompNewsNetwork) - The Division of Workers' Compensation (DWC) has received approval from the Office of Administrative Law (OAL) for its revised ethics regulations governing the conduct of workers' compensation judges.

The final regulations were filed with the secretary of state on Aug. 25, 2008 and will become effective Sept. 24, 2008. The approved regulations, as filed with the secretary of state, can be found on the DWC Web site at ht tp://www.dir.ca.gov/dwc/DWCPropRegs/Ethics_Regulations/Ethics_Regulations.htm. Also available on that Web site is: the final statement of reasons for the rulemaking, a summary of public comments made during the rulemaking and the division's responses to those comments.

The regulations seek to make more specific the ethical obligations of workers' compensation administrative law judges, and to make the regulations more consistent with the ethical rules applicable to superior court judges. The text of the final regulations is the same as was published with proposed modifications after the public hearing on Jan. 7, 2008, and was the subject of a 15 day public comment period.

The regulations are mandated by Labor Code sections 123.6 and were developed in consultation with the DWC court administrator. The existing ethics regulations had not been revised since the position of court administrator was created by the Legislature.
