NY Temporary Suspension of Dr. Dwiref Mehta's Authorization to Treat Injured Workers

Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board has exercised his authority to temporarily suspend Dr. Dwiref Mehta's authorization to treat injured workers within the New York State workers' compensation system effective May 23, 2013. Dr. Mehta's last known business address is 330 9th Street, Brooklyn NY 11215.

The Chair's designee's investigation revealed that on April 9, 2013, a deposition occurred at the New York State Workers' Compensation Board, Office of General Counsel, located in Schenectady, New York, wherein Dr. Mehta admitted to examining claimants for the purpose of making Schedule Loss of Use determinations and permanency assessments, subsequent to the revocation of his authorization to perform independent medical examinations. His authorization to perform independent medical examinations had been revoked effective July 2, 2008. Furthermore, Dr. Mehta in violation of Workers' Compensation Law § 13-d(2)(f) for failure to timely respond to questions and requests for information in connection with a Notice to Produce sent to him following the deposition. Therefore, the Chair believes that Dr. Mehta may be guilty of misconduct.

Dr. Mehta is prohibited from rendering treatment and care to injured workers while his authorization is temporarily suspended. Reports submitted by Dr. Mehta for services rendered prior to May 23, 2013, are valid, but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Mehta for services rendered prior to May 23, 2013, should not be denied due to the suspension of his authorization.
