Kentucky Supreme Court Extends Age for Indemnity Benefits Retroactively
Tampa, FL (WorkersCompensation.com) – Last month, the highest court in the Bluegrass stated handed down a new opinion expanding monetary workers’ compensation benefits in the state. In the case of Holcim v. Swinford, the court ruled that the amendments outlined in Kentucky Statute 342.730(4) which limit indemnity benefits to age 70 or for four years after the last exposure, apply retroactively.
