Will this effect my statute of limitations?
#1
I had Carpal tunnel and cubital tunnel surgery on one arm almost 6 months ago and should be released by the Dr. in a couple of weeks. My company had me fill out an accident report when I brought it to there attention but the report was only for one arm. Now they have asked me about the other arm and would like to keep my case open and do the other arm on the same workers comp. case. My concern is will this affect the statute of limitations leaving me out of a settlement for the first arm, or maybe both?

technically speaking the statute of limitation applies to when a claim is reported.
there maybe other time limits but those vary by state.
disability rate is usually based on the date of injury. if you have had a recent change in wage rate you might be better to file a new claim.
many answers depend on the state laws and that's why we ask that you indicate your state when asking questions.

I had Illinois in the top line, don't know what happened to it. I have to question the statute of limitations only applying to when a claim is reported. doesn't the date the Dr. releases you figure in there as well?

http://www.iwcc.il.gov/handbook020106.pdf

you can review all the different Timelines on page 108 of the act
