if you agree with the impairment rating the court can approve it in a few months.
If there are issues then there is no time limit for the parties to resolve it.

the next step depends on the issues in your case. if there are no disputes then the paperwork can be drawn up, signed and sent to the court in a matter of weeks. there are no time limits on how long the parties have to prepare the paperwork.

you are at maximum medical improvement when there is an opinion by a doctor.

if you are going to get another atty make sure to get one that specializes in workers compensation.

Mariannerita, you must keep in mind, as we feel and know we aren't being treated correctly. That the employer, and their Insurance Carrier have to go by the Work Comp Laws, Rules, and Statues of your State. This is everyones tools for this process. Yes, there are angles, and yes all this can take a long time to hash out. getting an attorney to work in your best interest is the only best way to combat a legal system.

Keep in mind, none of these people know your mane, nor will they ever remember it. ou a number on a piece of paper is all to them, nothing more. And when their done, they toss the number in a can, or simply just file it away to collect dust somewhere, we know one will care anymore.

systems like workers compensation, social security, department of motor vehicles, franchise tax board, veterans administration can't "care".
systems are not people. people work within systems but systems are not people.
people are subjective. people have bias, prejudice, ethical and religious values etc.
the system keeps those "people" things from being used to make decisions on your claim.
if you want workers comp to "care" then you have to be prepared for workers comp to reject your claim because your religion is different or you nationality is not what they like.
or only accept claims and pay the highest benefits because of the color of your skin or the type of job or education you have.
Caring goes both ways and includes not caring for other types of people. No no one can care about everyone equally.
But a system can be as neutral as the laws it implements.
not caring like you want it to ensures that most bias and prejudice is limited as a factor in the decisions.
systems that reduce bias and prejudice have a place in a democracy and a free society.

Hi and thanks for responding,

The attorney I had did nothing except tell me information that the IC said. He wasn't able to get my mileage reimbursed, or expedite doctor's appointments, and it took forever to get a 2nd opinion scheduled. So, what is the purpose of having one? All he did is tell me what I can't do or must do but I don't think he worked on my behalf at all.

Are there attorneys out there that will represent you and not just transmit information?

Attorney's don't expedite doctor's appointments, then they can do little when it comes to a second opinion doctor, as this needs approval from the employer, or their insurance carrier. What you want from an attorney, your not going to get. A work comp attorney is there to handle the legal part of your case and go home and sleep each night. You have the wrong opinion of what a work comp attorney can and can't do for you.

Up above is your State work comp site. It is highly advisable you learn the work comp system of your State. In fact this has been told to every injured worker. How can you know, unless you learn it. But, can I or others combat a system made up of legal issues? Mostly not, that is why we then higher attorney's. Without one, you would not be able to talk things over with the Insurance Attorney's, and know all the legal whatever's that go along with it, which form to fill out and when.
