Do I Have to Work for Same Employer
#1
California: If I get released back to work, whether or not with restrictions, probably with restrictions, but at any rate do I have to return to work for the same employer at which I was injured? The case is far from being settled. actually it is still denied pending an AME but hopefully I am progressing somewhat enough to be able to do at least very light duty soon. I have not heard from my employer in nearly 7 months. I send in my physician statements after every visit but I get no response from my employer. I am represented by an attorney. I feel that given how my employer has acted, basically not acted and has not seemed concerned at all about my welfare that returning to work for them could be working in a hostile environment. So if God willing I am able to return to work in some fashion do I have to return to work for the employer who I have the work comp claim against?

no, you can take a job with another employer.
make sure you notify your doctor so that you do not exceed your restrictions.
the employer can reduce your Permanent disability by 15% if they offer modified work.
you are not required to accept.
