Who has switched attorneys with success?

I actually have two workers comp cases open against my employer. Jan 08 I had a neck injury requiring ACDF surgery on my C6/7. Later in the year after surgery and rehabilitation I was cleared for full duty and given a 25% total body disability. I was advised by my attorney after a failed mediation to start cashing checks sent by the insurance company after I was at MMI. In my mind, I was not satisfied with the bare minimum and I have never thought I was right after surgery. Constant pain with aches and numbness and tingling in upper extremities.

This May, my partner wrecked our vehicle and I went to the hospital with neck pain, shoulder and arm pain. It has been two months and my surgeon and a shoulder doc have both given pt for my problems, which is only throwing the pt at the problem and not fixing it. I have to go back to shoulder specialist and I am sure he is going to order a MRI for shoulder and nerve study I am sure. I have noticed my left ring and little finger are falling involuntarily. I still have pain, numbness and tingling in all areas. I have been out of work for almost three months.

I want so badly to change attorneys since I have felt my current one has done little to nothing in both cases. Has anyone on here changed attorneys with success? I hate to stay with one just because he is familiar with both my accidents and cases. On the other hand, I could be missing out on one that wants to fight for me.

Hi, and Welcome to the Forum!! W/C is State Specific, so if You could Please let Us know what State Your Injuries Occurred in, it would Help Greatly to try and get You More Precise Advice! My Attorney has been Great, so I've not had to Switch, but there are a Few Here that Have, and Hopefully they will be on to Help Soon! I'm Assuming the Vehicle Accident was while Performing Your Work Duties, You didn't Really tell Us Your Line of Work! Best of Luck, and I'm Sure when Your Info. is Posted, Someone will be along!!Wink

i did and it cost me $2000.00 he did nothing for me. he came to my last court date and fought for it. i pay him 10 bucks a week. new attorney is great.

I'm a little confused on why you need to or want to switch Attorneys. As your Post shows no real reason to switch.

All physicians start with conservative treatment such as meds ,testing and Physical therapy . Surgery is a last resort treatment.

It seems to me that my attorney does not care about me as a client first and foremost. Also, I feel that during mediation back this March, he kind of "Laid Over" against the insurance company. He did some thing during the mediation, now that I have thought about it, seemed wrong to me! He went and talked with mediators and insurance company for several minutes in a closed room without my presence. Have a feeling maybe he took some money from them to go away maybe.

He used to be pretty good returning my emails, but as of late, he takes several days and basically impossible to talk with on the phone.

I am still fairly young and many years left in me with a pretty substantial disability rating...Not to mention, still in PAIN with symptoms. I lost around $15K so far since this year and last year and only got $34K spread out over a year in a half. Not quite sure I can continue my career now.

Does that answer the question why I am considering seeking other counsel? Not that I have made my mind up yet as personally I like my attorney. Or am I being over sensitive about my condition and expect more? Please chime in.

my lawyer and the WC lawyer played golf together among other things...they go in the room together to see where in the process they are.........The lawyer pool is a small one and of course they are gonna know each other and the judges........Is he selling you out? I doubt it but google him.........sometimes its hard to remember we are not our lawyers only client........
........I love cats, I just cant eat a whole one by myself......

Thanks Jayne! Guess I needed to be knocked back to reality a bit. But you know it is so damn personal and when you get involved in WC, you feel like everyone is against you. Like I stated, I really like my attorney, but I do get annoyed with him at times....Yeah I forget I am not his only client. It has really been months since he and I had a good discussion in the process of where I stand.
