I spoke with my claims specialist at the BWC and our line of thinking on the IME dr. giving me the rating was because of the 26 wk. wait time before I can file for PPD. Does that make sense? I'm fairly certain that my treating dr. is going to agree with the IME dr. because after my last couple of appts. with him he was getting frustrated with me on not getting better but couldn't offer me any other treatment options. 1171 stated that I should be able to file for unemployment....shouldn't I do wage loss compensation instead? My restrictions are preventing me from finding suitable employment. My employer(yes, they still have me employed there) just doesn't have any "light-duty work available for me within my restrictions so I would think I'd have to do the wage loss compensation instead of unemployment. I know I can't do both.....
