Yes they know about the RSD.

I was diagnosed with depression in June from going thru everything with the RSD and the injury. I have been using a crutch for 17 months. While the psych doctor wanted to see me back to continue my treatment for depression. He said it would only get worse and that I would need medication for it. Well here it is in November workers comp have not returned the many phone calls from myself, the doctor or the faxes from the doctors. They return no calls at all. I never get all my weekly benefits in one month they are always late. And since my injury ago they have paid for just one prescription. Everything else my insurance has made as for as the prescriptions. They told me Rsd was curable and than I find out that I will be living with it for the rest of my life and I have two small children. I can't do anything. I am just so depressed about all this mess. We went to a lawayer for a free consultation and he said we had a very good case. I am just afraid workers comp will stop what money they pay me.

As everyone said getting an attorney is a personal decision but with the problems you have described I would at least go talk to an atty. I hired my atty as soon as I found out I needed surgery. Had heard horror stories about w/c and the way they treat the injured workers and did not want this added stress so let my atty handle all this. Now am so glad I did! It has been an ongoing battle with work comp for everything.

First off you need to report the IC. to the wc labor board. Let them know that the IC has not been making payments to you etc. Someone once posted a website with a phone number to report an insurance co.

You should be also getting mileage reimbursement for the miles you drive to and from the doctors. Some states even pay for people to go to the pharmacy to pick up medication.

If your payments are late, the IC should have to pay a penalty for paying you late, so I would not hesitate to report them!!! The penalty will go into a fund. At least that is what they do here in NH.

you should put your state in your profile so responses can be specific to the rules your claim is controled by.
it does sound like there is a dispute/issues about outstanding benefits.
while the legal system can be very slow and cumbersome it is the only way to get a denial or rejection of benefits changed.
The legal system will not provide much information or hand-holding or any quick solutions.
Once you litigate you can never go back to use administrative remedies-you're stuck within the court process.
Before you take that step I'd recommend you contact the Ombudsman with your most pressing problem:treatment for your depression. If they are not able to help you will have to get a court decision.
