Hi to all,
I just wanted to know if anyone knew exactly what happens during the pre-hearing conference. Mine is scheduled for the end of November and I am clueless of what goes on. This is my first time dealing with w/c. I live in Missouri. Also, I just received a copy of my medical rating. I fell at work in Feb. and went through two rounds of therapy before being sent to a orthopedic specialist who in turn told me I needed surgery due to torn rotator cuff on right shoulder. That happened in June and now am back full duty at work, I am in child care. My permanent rateable disablility is 8 percent. Does anyone know what this means? Will I still receive any lump sum payment for all this I am going through? I am still hurting and it could take up to 2 years before it completely heals, that is what the doctor told me. Thanks for any info.

I believe it depends on the purpose of the hearing; would it be a settlement hearing?
All states are different on how they pay out settlements. It would help it you would post your state.
Do you have permanent restrictions? I ask because I worked as an Early Childhood Teacher in a child care setting, and was injured while caring for a child experiencing medical problems.
My employer will not allow me to return to work as long as I have any type of restrictions.

There are different types of adjudication proceedings in missouri's work comp system. Your notification letter should have given you information as to what the issue would be and what type of proceeding was scheduled. some types only apply to those who are represented while others are admistrative.
do you have an atty who filed with the comp court?

All my paper states is pre-hearing conference. I live in Missouri.
No, I have no restrictions either. I am full duty now. I work before and after school (latchkey) for elementary grades.

generally such a conference is used by both side to lay out which issues remain unresolved and to make an attempt to settle them without risking a court decision.
Ratings are used to calculate additional disability payments- the higher the rating the longer the payments last with 100% being totally unable to work at any job.
