Is it considered fraud to use your own personal insurance for a work related injury? I just want to have control of my medical treatment. I have not filed a claim yet but I had a claim before and it sucked having some adjuster making me wait weeks for approval for any doctor ordered treatment.

If you lie to your own personal insurance company and tell them your injury is "not work related", then yes, it would be fraud.
It would also be fraud in the opposite situation, if you report a non work related injury as a "work related injury".

i suppose you could ask them to deny your work comp claim for some technicality and then take the denial to your health carrier for treatment.

a denial by a work comp carrier can be appealed as long as it's done within the time limits.

1171, how can they have a denial, for they never even filed a wc injury or claimed one?

keep in mind if you turn a work related injury in to ur health insurance and they pay for it and they find out it happen at work they can make you repay them what they spent.
