I acquired a back injury in 1989. It was settled in court a couple years later. I had all ready received 100% certification for SSDI. Although, apparently, I was not properly represented, my counsel was wise enough to convince me not to accept a "buyout" for my medical treatment/s. It was aggreed upon that a particular Orthopaedic Specialist would be responsible for continuing treatment. My problem is the the third party provider of pharmaceuticals has been nothing but a pain since the begining. The latest incidence is I have been without medication/s for the past 10 days. What I'm wonderin' is does the law require me to accept this torture?
I live in Alabama. Case was settled in said state. I will, also, volunteer that I am a Traumatic Brain Injury survivor from a previous accident in 1987, so, sometimes my reasoning faculties don't operate with any expedience.
Any assistance will be greatly appreciated.

I would contact the state and let them know what is going on. I think there is an ombusman program in Alabama and they can help get the medication thing straightened out as to why your not getting your medication on time.

Your former atty may still be authorized to represent you on the continuing work comp benefits.
I would discuss bringing enforcement action against them thru the state work comp court. If nothing else get them to hire an atty and have to show up and explain their actions to a comp judge.

Thanks for the input. However, research indicates the only Ombudsman resource available in our poor state deals only with long-term care and assisted living issues for the aged. At 52 I don't fit their quals.

Thanks for imput. Have learned previous counsel was/is criminal defense specialist. He obtained services of more experienced representative for my SSDI -thankfully-. I just about had to pry my WC settlement from him after all sorts of miscelaneous fees started showing up- not sure if he was as much to fault as the "para-legal" that pretty much conducted/arranged the SSDI and WC. Settlement reached before an elected "Circuit Court" judge that is no longer in office.

I understand that the issue is with a wc claim. I see that you are receiving SSDI. I wonder if a SS advocacy group may be able to point you in a direction to resolve the issue.
8-05, Micro laminectomy/disectomy. 10-05 lumbar fusion L5-S1. 2-07 exploritory surgery. 12-07 medical implant, Spinal Cord Stimulator. now receiving SSDI. After going back to school, I received my degree as a mechanical engineer. What can I say, it was the only way I had to beat the system.

I will begin by thanking all for the assistance provided.
Yesterday I attempted contact with the Insurance agent assigned to my case. SNAFU as usual, contact phone number provided no-longer connected. After searching and sorting I get connected to a recording - I don't work well with such. I called again this a.m. with same
results. I called attorney and was told "court-week" had him on the run but I would be contacted with an appointment asap. I called supplier to check on a status up-date;- on closing contact yesterday, I did state I was being forced to seek counsel.- I was told Rx was shipped overnight and to expect delivery whenever UPS ran. I know the man on the local route, so, I got in touch. He made arrangements to meet me so I could get Rx before late this evening. I obtained and verified Rx was the correct product and dosage. I then called UPS and commended driver for "above and beyond". I then called Dr.'s office and told them I finally had a correct Rx in my hand. I thanked them for their assistance and wished them a Merry Christmas.

Upon reviewing Rx label it does appear -to me anyway- that they may think this is amount for 90days. It is only sufficient for 45days. So, I'll probably have to go throught the "deny, delay" procedure again when this runs out. Howsomever; I will meet with Counsel and determine what actions may be brought to bare if/when it continues.

Sometimes blowin' off steam 'fore the reactor goes proto-critical has a calming effect.
Again thanks for your assistance. I will pray that all have a Merry Christmas and pallitable resolution to their problems.
