Lost afraid and confused
Hi all, I am a civil service worker for the city of New York for 14 years. I was injured on 12/4/06 when i fell from a 7ft vertical ladder and landed on my back. After numerous test including MRI EMG showing my diagnosis as Bi-Lateral lumber Radiculopathy (Bulge disk, nerve damage). I have been denied my benefits from 2/07 until present due to a 5 min IME exam and a heartless IC. The WCB system has failed me like so many others. And now i am as of now on the verge of being homeless and am no closer to a decision as the first day i was injured.
i live in NYC and i am in shock from what has been happening to me since my injury. I am being denied my medical help, pain meds and weekly checks by the ic while i have already went to two hearings. My first on july 3 07 and at that time judge wanted all doc reports in to her in 60 days like a month ago i get the notice of a hearing on Oct 3 at that hearing i see another judge who stated he cant make a ruling because he did not read the reports needless to say i was in shock the judge then ordered it to go for a reserved disision by another judge. When i left the court room i asked my lawyer why he did not say anything he told me well we cant question the judge on why he was not ready or why he was not up on my case that might make him mad and rule against us. I have now spent most all my savings and am lost and scared with alot of pain walk with a cane at times to help me along when my leg goes numb. i thank God that a chiro is seeing me 3x a week without getting paid by the ic. He states that he knows i will win and he will get his back pay. Me i am not as sure as he is. I am scared the judge will deny me my benefits i never had any luck in my life and dont see it changing now. I see myself as being a homeless disabled man who has worked for 30 years and never asked for anything. My only crime was i got injured on the job. God help us all, that get injured on the job
i dont have any answers but i can offer up prayers for you we have a off topic section on here that your welcome to drop in on where we all share out pain and sorrows and laughs and games its not a answer but it helps to feel better if just for a while we also have a 900 prayer time you can add your self too we are just family on here welcome sweet tooth

All i can say is i am ashamed to say that us americans do not take care of our injured workers first and focus on the foriegn people that come into this country for health insurance, etc. It just is not fair that your own country can sit back and watch you go through pain, homelessness and suffering.

I wish you luck and hope the judge sits down and reads your case like he should be doing to help his fellow american get the help in this country that you deserve. Such a sad thing to have you work so hard while others sit back and get everything for free. I wish you the best.

Hi Tony,

My prayers go out to you and your family. I am so sorry you are being given the runaround. like Sparkey said seem they have more important things to do then to take care of the people that made America what it is today. As far as your problems I don't know about NY, but in cali. you are able to apply for State Disability if you are denied by workers comp. and if you still have medical ins. you should go to the doctor and explain to them what is going on they can treat you and put a lien on any settlement that comes out of your case. I have heard that NY is the hardest place to get proper care and treatment when you get injuried. For your sake I hope this is not true and something happens in your favor really soon. Maybe someone will be along soon to give you some good advice.

This country is going to the pits, slowly but surely. What a tragic thing that we can feed the starving in foriegn countries....but cannot take care of our own. 9:00 is the prayer time as Sweettooth said...be there. We will be present and you will be in our prayers!

I'm sorry to hear of Your recent developments, and the way the System is treating You. All I can say is keep up the Battle, and don't forget SSDI. You have been off of Work long enough to apply, and it takes some time, so You may want to apply soon. Best of luck, and I surely Hope things turn around for You!!Wink
Thanks all for taking the time to read my post. a prayer time is a good thing it can't hurt even do to the Fact that me and God are not on good terms these days. I went to my chiro this morning so i could not make it. I am just trying to find ways to survive these days. i have put in for ssd but i know that can take years and in Ny you are always denied the first time so that is no real help for me at the moment. I can only pray that my bennies are approved with a MRI and emg showing damage and the pain i am in i cant understand how a Ic's Doc (IME) that did not even examine me has more wait then medical evidence. Has anyone seen anything like this ? and if you have did the IW win out in the end ? Thanks again Tony !!!
I am so sorry that you are going through all of this non sense. I too will keep you in my prayers. I know you mentioned the info. about SSD, but have you considered SSI which is for low income people, which if youre out of work...you fit that catagory. This is through the social security dept. but is a seperate proram and is much quicker that the years it can take for soc. sec.

I also was seen by a w/c Dr. for an IME and it lasted literally 5 mins. ea. time. ( I saw the same one twice and both times he said that he did not agree with the other 3 specialist, who said I needed surgery.) The only thing that I can say is that the company only hires them, if they can keep the judge from making them pay you, basically. It is such a shame. After a spinal fusion, I had some problems that the surgeons said I needed to get back in to have the screws switched out to stronger ones. They were afraid that the ones that were in me could break off in my spine and could paralyze me. When I asked my lawyer how the i/c could deny this and what would happen if I became paralized because they made me wait...she said it is unfortunate and that they would have to pay for that, but they could care less about my health or my new limited lifestyle.

It's funny you should ask that question. I am in the process of fighting a AME's report right now mines is in reverse though. I have been with my job for 22 years with only 1 year to retire with full benifits, I guess the company feels that if they have to pay me for my injuries they will take my retirement. I like you saw the AME all of 15 minutes and he was able to override all the other doctors I have been to over the years. It is truly criminal how they treat the i/w

OMG Tony....I feel so bad. Thank God for your Chiro. I am so sorry you have had to go through this. It is soooooooooo scary. The system is a disgrace to say the least. Your ending line says it all. That's all any of us have done is work our butts off for many years and make the mistake of being injured. We are treated like criminals by most. God be with you, my prayers will be.
