Life Care Plan Florida
#1
I was paralyzed on the job 29 years ago. A life care plan was put together to take care of me for the rest of my life. In the plan it covered a new van every 4-5 years, wheelchair every 5-7 years, attendant care, suppliers etc. Over the years I have received a new van but workers comp always puts up a fight. I'm due for a new van now (current van is over 5 years old with 112,000 miles) and the fight starts. What I don't understand is there was a lot of money put away to take care of me for the rest of my life and they fight me over what the life care plan says I should be getting. Am I right on this? Any help is appreciated.

Im not sure what you mean by “put away”?
Was there a specific deposited amount in a blocked bank account administered by a third party?

Or are you just referring to open ended future medical award ?
How exactly was your the finalization of your benefits worded— there had to be a written document.
Reminder :
........Each state has their own comp system; POST YOUR STATE to get accurate information. Use the search feature to find information from similar questions.

When I was injured a nurse specialist figured out how much it would cost to take care of me for the rest of my life. A lump sum of money was put away to cover everything needed. It is called a life care plan.

I suspect the plan was used to estimate the future cost of your claim and
The carrier/ employer is still paying your medical. Whatever they don’t spend, they keep. It’s not your $$$.

My carrier/employer had to pay workers comp x amount of $$$ to take care of me until I die. In the plan it states I am to get a new van every 4-5 years, wheelchair every 4-6 years, attendant care etc. That is what the $$$ is for. So why is workers comp fighting me on getting a new van after 5 years and 112,000 miles?
