Shoulder surgery
#1
Hi, I had rotator cuff surgery Nov, 2019 at which time I got Aspiration Pneumonia from the surgery and spent 4 days post-op in a cardiac unit due to Acute Respiratory Failure. It is now the end of April and I still have pain as well as very poor range of motion. I had a steroid injection and it didn't help. If surgeon recommends another surgery, do I have to do it? I almost died from the last surgery and don't want to have another.

It’s only a recommendation; the decision is yours alone. If there are no other treatments available, the doctors will likely determine that you have reached Maximum Medical Improvement.

You can also switch doctors at any time. When you are deemed MMI/ P&S your TTD benefits will stop (if you are receiving them currently). You always have the option to switch doctors and can go to another specialty such as pain management etc who may not recommend surgery and P&S you if he feels you have not reached MMI/P&S. If your current doctor is a surgeon chances are higher he will recommend surgery.
I am not an attorney.Anything I write should not be considered legal advice.I am writing from my own personal experiences, which is not from any sort of legal background. You should consult with an attorney over legal issues. In California, if you cannot get an attorney you can consult with an I&A officer.
