Can an accepted claim go to trial?
#1
After talking to an attorney over the weekend, I realize that these hearings I’ve been going to were more like mediation and the judge isn’t obligated to review any of my evidences.

I have a continued msc in a few days and I have to list my pre-trial statements and evidence. My claim is accepted and the carrier has approved my treatment.

I dont mind trial but I wanted to know if the carrier can dispute the medical side of my claim at trial? Im not mmi and there won’t be a a rating until I complete the treatments the qme recomended.

Unfortunately I can not reschedule the hearing because I’ve lost 5 months with these hearings. There’s not many attorneys that will take my case on short notice and it will be harder if they are not there to list the evidence.

Thanks

The insurance company can deny your claim at any time until you settle and a judge rules on it.
I am not an attorney.Anything I write should not be considered legal advice.I am writing from my own personal experiences, which is not from any sort of legal background. You should consult with an attorney over legal issues. In California, if you cannot get an attorney you can consult with an I&A officer.

Thank you, I was just worried the IC will try and dispute the medical if I go to trial. I have my last msc in a few days and If we can not agree then it will go to trial. I wanted to go to trial a few months ago. It would have saved a lot of time.

How long is trial if there is no witness for both parties? If the judge ruled I’m owed ttd, is there a time limit for the carrier to make payments?
