NY-I just received notice from the Workers Comp Board that they ruled in my favor and against the carriers appeal. The Carrier claimed that the SCS that was placed in the thoracic region for lumbar pain was not their responsibility because the thoracic spine was not an established body part. The Comp board also fined the carrier a substantial amount of money that is to be paid to me. Now I guess I just wait to hear from my lawyer to see what the next step is.

Yup. There are different additional levels of appeal so the litigation may not be over.

I spoke to my lawyer Friday and they said this decision is final and there’s no legal recourse for the carrier.

Not sure what is the whole story, but I am happy for you. If it is anything like my situation with the carrier, I hope they get stomped on by not taking care of my neck. They agreed to my shoulder injury only, while ignoring the chronic neck pain. Did you go before a judge?
