Terminated for cause and human resource falsify records

I’ve searched for answers the last few days and have not found much. If anyone has been in a similar situation, I would love to get some feedback. This is getting so bizarre and it can have more surprises. I’m not sure what or where to get this resolved.

(The dates I’m using are not exact) I was terminated for cause on the day I took my doctor note to the workplace. I spent about an hour with HR and I receive a letter of discharged. She said it was an ongoing investigation.

Date of incident; 1-15-17

Date of injury- 2-12-17(this is also last day of work)

Date of termination- 2-24/17

The company letter to edd has the incident date as 1-26-17

The letter in company file has date of incident as 2-24-27.

This would make it appear that I return to work and then I was terminated for not following procedure. I thought something wasn’t right when HR offer to pay 8 hours on 2-24 and the following day. This was her plan to avoid liability for my injury.

IC has been giving this information from employer and they never contested that I was terminated for cause within the 90 days.

I have all the documents that shows the different dates. The IC new denial letter does not give information to appeal it.

What course of action can I or should I take?

The only recourse I am aware of is to take it to trial. It sounds like that is what you are doing. Make sure you present evidence.

As I have been recommending all along you should consult with an attorney and hire one. These issues are complex and obtaining info on a message board with submitting limited facts is not a good idea. Get a professional to help you. Attorney's know how to deal with these shenanigans. It looks like it’s going to go that way. I’m prepared to go to trial. At this point, I would prefer to go to trial so I can put them on the stand. It will give me chance to clear my name and open the flood gates.

The only evidence I have are the ones the sent me. It’s cleared that the dates are completely different. Their witnesses that conspired to questioned my character were all given the boot. They will probably have a different story to tell the judge. I’m not sure if vindication would be satisfying.

I’m wondering why I can’t pm?

Oh nice, I thought it was just me.

I have a friend that is going to a psychiatrist evaluation. He wanted to know how that process works.

Is it with work comp?

I never went through that process, I am sorry. Maybe someone else will answer.

Whatever happens with this work comp case I wish you the best of luck. I would feel better if you had an attorney to help you. That is your decision how to move forward. There is a lot of information you can access on the states website and just use their search engine or you can google it. It sounds like your help with I&A officers are a hit and miss. Some have more experience than others.

I do hope you take my advice on going for walks or any exercise your doctor advises. It will help keep your body and mind healthy. It helps with depression and anxiety. While this system can make you feel like you do not have control of things such as denials and the shenanigans they are pulling on you, they do not control how it affects you nor do they control things like you eating healthy, diet and exercise recommended by your doctor.

I really appreciate your sincere feedback. This might be the only forum that is truly for injured workers.

The qme did say I need to get out more. He wants me to be positive and exercise more. I think he’s putting in a request for equipment that I can use at home.

He wanted me to see a specialist so I was worried. I agree that it’s for the best. Lately I’ve had to ask myself if what I’m saying is real. I really don’t have anyone to talk to when my kids go to their moms place.

It’s weird that I talk to their attorney more than anyone I know.

The qme wants me to do physical therapy and the IC approved pain management. I ask my doctor about pain management and it sounds like it can take a while.

How can I get a tens unit? The first qme report recommends one and this qme said I would need one too.
