Labral Tear Tennessee

Greetings all,

Seeking advice for a settlement and I can't seem to find it addressed here in other threads.

I am in Tennessee and have a confirmed labral tear in the shoulder of my dominant arm. Due to some horrific circumstances unrelated to this, I need to attempt to settle without having surgery. My questions are;

1) do the TTD payments stop immediately when I ask to settle?

2) will the cost of the surgery needed be factored into a settlement? And any idea how that calculates roughly (meaning 100% of estimated surgery cost or would they offer less)?

3) I know that the IC can wait some ridiculous number of days to make payment once MMI is reached, does anyone have any experience/knowledge if it can be expedited simply to close it out and get me off their books?

4) any idea based on experience or firsthand knowledge what total settlement would look like with no surgery and forfeiting all future medical? I know there are some factors to consider and MMI rating is not yet determined. I am over 40 and TTD is about $580 weekly.

I realize that cashing out has its risks. However, my personal circumstances are such that it truly is in my best interest and I need advice on how to close this whole thing out as quickly as possible.

The best/ fastest is to get legal representation from an experienced comp atty.
They know the medical community as well as the details of comp court and may have first hand experience with employer/carrier/defense atty.
