New to all this but being forced to dispute - Texas
Bear with me, I'm researching and it's a lot to take in right now.  I really need the help of people familiar with all this.

I worked for my company for 5 years before going out with an injury on Dec 3, 2015.  I was immediately diagnosed with a lumbar sprain and went through a month of physical therapy.  After 6 weeks they finally gave me an MRI and discovered that I have 3 bulging discs with radiculopathy.  Since then, I've had an EMG that confirmed it, an orthopedic surgeon that confirmed it, and a steroid injection that didn't work.

Now my worker's comp insurance, after more than 10 months of paying me benefits, has heard the word "surgery" and immediately sent me to a chiropractor for my MMI and impairment diagnosis.  In the paperwork they sent for me to give to him, they ordered him to only make the diagnosis based on the original "lumbar sprain" diagnosis, and said that the bulging discs were not the compensable injury and to ignore them.  Based on that, the chiropractor claimed that I reached MMI on March 11 of this year, and put me at 5% IR.  So basically I'm being dropped right now.

I know I have to do something.  The bulging discs are the injury and I need surgery, as well as my benefits.  I need to dispute the fact that they're only covering the "lumbar sprain", and by proxy the MMI date and IR.  I have absolutely no idea how to start this process.  Can anyone point me in the right direction?

since they are denying the disc herniation is caused by the work you will need medical evidence to the contrary. the dispute can then be resolved by negotiation or DWC decision.

you can get professional legal representation; most states have time limits to begin litigation.

Or at least contact the office of employee counsel
