Hello, I had an MSC for settlement on 2/22/17, another submission was made to CMS for my MSA and other issues could not settled, EDD lien, PD op, TTD op, and multiple DOI and rating. MSA approved on 4/5/17 for 205,000 (I am requesting lump sum), LIfe exp. 12 years. MSC is now set for 5/17/17 and I have been advised it is unclear about settlement, and the EDD lien is unclear how it will be resolved. The MSA proposed settlement date is 6/28/17; I do not know how this date affects my case. I have been advised there most likely will not be settlement on 5/17/17 and it will probably go to trial. I live in NV now, and am very ill with non-work comp issues. I do not think I can travel to Santa Ana for the trial and would like to settle at this MSC. Can you please give my direction on how to settle at this upcoming MSC. If there is no settlement, how many times can my case be postponed. Thank you.

You need to communicate the urgency to settle quickly to your atty. let them know you can't travel.
The more desperate you are to settle the more your atty will have to give up in the negotiations.
There is no limit to the number of legal proceedings; any decision by the court can be appealed.
Your best hope for a "quick" settlement is to persuade your atty to give up his arguments for a higher amount and accept whatever they offer.

Thank you, I will do everything I can to get the law office to schedule a telephonic with my atty.

Be insistent. The atty fee is based on the size of the settlement so it,s in their interest to hold out for larger amount.
