WC Newbie
#1
Question
Good morning.  I'm in California. Filed my first WC claim, after four surgeries for repetitive stress injuries, and looking at my fifth upcoming surgery.   I've been a Legal secretary for the last 25 years (never WC).

Injuries/Surgeries are as follows:

Cubital Tunnel Syndrome left arm & right arm (ulnar nerve entrapment, ulnar nerve transposition Left arm & medial epicondylectomy Right arm)

Lateral Epicondylitis right arm

Right Shoulder impingement with SLAP tear repair, bone spur, debridement and biceps tenotomy

The ulnar nerve on the right arm has become entrapped again, I've got muscle wasting and a clawing pinky finger.  My Right shoulder again has tendonitis and now showing AC joint arthritis.

I do have an attorney.  My attorney amended my claim to a cumulative trauma claim, WC denied my claim.

My QME is on 6/24/16.

I'd like some insight as to what to expect from here.
Thank you!!

You'll wait about a month for the QME to file their report with the parties.
After the report is reviewed by each side they'll decide what more needs to happen either to start benefits or go to court.
You may be contacted by your atty office on what the report says.

Thank you 1171. Is it unusual for WC to deny a claim prior to the QME?
If WC adjuster disagrees with QME report (Dr. is from the California anonymous 3 panel selection) can they request another QME or AME? Or do they have to accept what his findings are?

They are legally required to accept or reject claim promptly when one is filed.
In order to get an AME the other side has to "AGREE" so that option is always available.
Generally only one QME.
