CA - need to find a new job - mentally tapped

I have wanted to give up time and time again on this whole work comp process. It has been long and stressful and I feel I have done more work than anyone paid to help me. It isn't over, but nearing the end.

At the end of the day, I have to find a new job after 18 years with the same company. I am angry and bitter about that because I loved my job and had a career path there that I wanted to follow.

Now I don't even want to work in the same industry...but torn what to do now. I don't have a degree but can go back to school...just don't even know what I would study. I truly feel lost and don't even know what type of work I want. Anyone else feel this way after something like this?

My doctor and my lawyer keep telling me to move on but for some reason I am struggling with doing that. Which is new for me - I've always been a go-getter and very optimistic. It's like that part of me is gone now. I know I am depressed etc. but I refuse meds (long story).

I guess I just wanted to vent a little...maybe hear from folks who have been there, done that and wants to share with me how they were able to overcome these major life changes and move on.

there are still a number of vocational rehabilitation experts from the work comp field who maybe able to help focus your return to work efforts.
you can use your voucher $$ to help with the costs.

1171 is correct, you should qualify for vouchers from the state, if you give your year of injury (do not give exact date on any public site) I can advise you on what benefits you may qualify from OR you can click the link 1171 provided.

There are people on here who have gone back to college to further their education, returned to work with their employer, or looked elsewhere for work. If you are interested in college and do not know what you want to do, I recommend taking some general ed classes and also take a career counseling class. You can usually take this on-line as well. It is usually a one credit class that tests you on your interests, personality and skill, and then provides a list of careers that would fit with what interests you. It also shows you what different professions, pay, what degree is needed and also how much the position is needing people to hire. You can use your vocational voucher (part of it on vocational counseling, but I have read some negative comments about it being a waste of the voucher.

My date of injury was originally 2011. I was re-injured in 2015 but never closed out my first claim (even though was declared P&S in 2012 with open medical). I hope this made sense.

I had been advised previously by my attorney that vocational vouchers did not apply to me.

they are familiar with your case so you'd have to fund your own rehab efforts.

Oh ok.

Here again is more frustration because I was looking through the link you posted above, and was getting excited that vouchers may be available. So I guess there isn't enough precise information in the legislation for all scenarios, my scenario not qualifying, apparently.

My attorney has given me conflicting information before. And I truly don't want to just constantly throw him under the bus but I am left to get info myself I just don't understand it and it has taken a toll on me, all the not knowing.

I also feel since there is a set amount he will receive as compensation, as he says there is no payments made other than what equates to my disability rating, that he doesn't want to help me because...why? What's in it for him but more work that he isn't being additionally compensated for? So since his salary will be auto determined by a number that will not change no matter what my circumstances, why should he assist me and actually work on my case?

All I've heard from him, is that he won't do anything for me unless it directly relates to work comp. So for example I was denied benefits from my disability company (supplemental to work comp) but he will not assist in my appeal to them because it isn't a work comp issue, even though the claim is a work comp claim they are denying benefits for.

I was denied treatment from my doctor after having received approved treatment for the same injury for 4 years and that denial interrupted my benefits for two months. I was already approved for work comp, but had to find a new doctor in the work comp network since my private doctor (preapproved by QME in writing) suddenly declined treatment. I have not been compensated for those two months and have to file my own appeals for that too because...not his job.

I don't know, maybe this all makes sense to others, but I can't wrap my brain around it. I just wanted to know what others have done to help themselves get back on track. I might be mixing up my posts...sorry about that...

PS - In case you are curious...I am hiring another attorney for a different type of law. The other attorney's office handles Labor, Pers Injury, Civil Rights and a few other types of law - they have a tentative date with me to sign a contract and are researching my case now to see if they want it. If they are willing to also pick up with the work comp portion of my case then that may work, but I don't know if they do work comp specifically and actually didn't think about them taking over this part until now.

I assume your atty has already been paid out of your prior award-- that may affect your new law firm's decision.
There would additional fees if you receive additional PD or there was a C&R.

I didn't have a prior award. Ever. No settlement...no payout...no award...nothing. My claim remained open.

i see; your prior rating was a medical opinion not a court finding.
it could be superseded by the recent QME opinion and indeed result in a final single rating rather then two separate awards.

So I have another question.

When I was given a rating by QME panel report before, and released back to work with a rating of 70% (the magic number - as I understand it - where benefits or settlement payments equal zero) but with open medical what exactly did that allow me to do?

I was denied coverage by my employer if I missed work due to this illness and / or needed to go see a doctor, I was told I was not allowed to use 'work comp' as the reason, because I was at work, and not on an official leave of absence. That being said, my claim was never closed and I thought I did have the ability to claim my missed time for appointments - and the question is specific to compensation. I was not compensated for time missed due to illness or to see a doctor (psychologist). I was not allowed to even document that time as under the heading of work comp.

No one has been able to help me answer this...so just taking a shot in the dark to see if anyone has any feedback on this scenario.
