Getting paid while seeking medical attention?
#1
I'm from the state of NC. I got injured at work, but they wouldn't let me get checked that day. The day afterwards, the pain got too severe and went to see the in-house Nurse. The nurse finally sent me to the hospital to get treated.

Upon receiving my check, I noticed that they did not pay me for the time I was at the hospital getting treated. Is that fair or legal?

Also, because this happened close to Christmas I was not able to work the day before Christmas Eve (per Dr's order) so therefore, I wasn't entitled to my paid holiday hours because HR said I did not work the day before the holiday (but i worked the day after the holiday). I missed the day before Christmas Eve because of the injury,  no fault of my own, & not because i was just goofing off. I wondering if I can do anything about this matter.

Thanks!

The NC comp laws provide a 7 day waiting period.
disability payments begin on the 8th day of disability. the first 7 will be paid if you are disabled for 21 days.

Yes, talk to your local legislative representative; they can change your state's the comp laws.

"waiting period" is lost time/disability NOT paid by workers comp insurance:

disability payments "begin on the 8th day of disability"

if the lost time was part of the initial 7 days of disability, then it is not paid by the comp insurance.

It seems clear to me.
they don't pay before the 8th day of lost time.
How does it not answer your question? what is it from the link I gave you that you don't understand?:

" When do I become eligible for lost wage compensation?

No compensation is due for the first seven (7) days of lost time unless the disability exceeds 21 days. Therefore, the first check will not include payment
for days 1-7. Payment for those days will be made should the disability continue beyond 21 days."

I don't think It can be explained any better.
you can call the information specialist to help you understand it better:
http://www.ic.nc.gov/infospec.html

P.S.
Employers don't continue/pay wages for time not worked unless you use approved leave or have a collective bargaining agreement that covers it.

I was only out of work for 1 day, and know that 1 day won't be covered because it doesn't exceed 7 days. I understand that.

This isn't about lost time, it's about getting paid for seeking medical attention when the accident occurred. I was in the hospital emergency room for nearly 5 hours after my original shift was over. Aren't employers suppose to pay me for the hours I spent seeking medical attention?

time off for medical appointments and treatment for a work injury is not covered by work comp as it is not disabling but taking time from work schedule for appointments may be covered by leave credits.
