Denied treatment for old injury
#11
As I posted earlier if the employer uses a network you have to stay in the network. Use the link.

Question
So I just had a "lovely" conversation with my adjuster who called to find out more information about the problems I'm having with my shoulders. She did everything she could to spin that there was no way my shoulder problems are because of my work, or that it was possibly made worse because of the injury to my upper back.

My question is don't they only have a certain amount of time to deny treatment once a problem has been reported to them?

I notified my employer on Dec 14th and she is just calling me today about it.

her decision has to based on evidence.
it depends on when they were notified that your shoulder problems were work related.

Thanks that's kind of what I thought. I am going to a meeting with TWC on Wednesday so I can talk to them then. Yeah I don't know how she can deny it based on evidence when the doctor won't even talk to me about it because she told them she was going to deny it.

if treatment has been denied, then file an appeal with the TDW and present them your medical evidence that it's caused by the job. that will easily refute the adjuster's opinion.

complaining about a late denial notification will not get you your benefits.
