You are lucky you were able to stop the settlement in time.
Do you have an attorney?

Being amazing i d probably have to consider it nerve pain is tolerable but its just a nagging pain that irritates me easily, i d be happier than i have been i just hope i can get it still since i C&R i was kinded niave i thought my regular insurance that i was about to get after we got married would pick up the injury but after asking kiser they said they would not so im kinda upset about that...

I want to make sure I am reading this correctly, did Kaiser say they would pick up your treatment for a closed work comp claim?

What kind of surgery is your doctor recommending, a fusion or discectomy? If you just have nagging pain, please research surgery, any surgery first and get a few other opinions.

I highly recommend researching having spinal epidural in the cervical spine. That part of the neck is much more risky that thorac/lumbar for having an epidural due to blood vessels.

I also want to mention that in California all requests in the work comp system can be subject to the UR process. Even though your doctor says you needs epidurals, surgery etc it does not mean it will be approved. I recommend weighing this out when deciding if it is worth it for you to settle. In my own opinion the California work comp system is not a good place to get proper medical treatment due to several things including the tough UR/IMR system. For example I have seen patients get approved for things like surgery and then after surgery get denied physical therapy, pain medications, post op testing's etc. One patient had a minor spine surgery, got a spinal fluid leak due to it and UR refused testing's and treatment for the spinal cord leak. These are some worse case scenarios, but I just want you to be aware.
I am not an attorney.Anything I write should not be considered legal advice.I am writing from my own personal experiences, which is not from any sort of legal background. You should consult with an attorney over legal issues. In California, if you cannot get an attorney you can consult with an I&A officer.
