Frivolously denied claim

I suffered a low back injury on 08/07/2013, filed for and recieved benefits until the insurance companys IME, when shortly thereafter received a NOID based on the IME and MMI. I subsequently had benefits reinstated by order dated 06/17/2014, finding there were no grounds for denial of wage benefits and still have restrictions. I recently received another copy of the IME, days later received another NOID which claims the same reasons as the first NOID. What Im saying is...they denied wage benefits once already, took them to court and won benefits back. Now they have stopped wage benefits again using the exact same reasons as before which makes it a frivolous denial of a claim. I have to go through another .239 conference and wait a month or more for my next check? This is ridiculous and feel like Im being railroaded from all sides. Any info will be greatly appreciated as my atty isnt much help.

most states have penalty provisions if the delay/denial of benefits is unreasonable.
being overruled in the past does not mean it cannot apply to all future times and circumstances.
just because you were not MMI then doesn't mean you will never be MMI.....
when it's at a different time it's not the same denial.

I had an MRI and 3 injections last year, recently had another MRI and waiting on approval for another shot, Surgeon said I will need fusion in the future, exhausting all other options first. Primary physician and chiropractor both say no work, and the only thing that has changed since judge ordered denial of discontinuance last June is further deterioration of my back(degenerative disc disease). I found MN statute 176.225 on penalties, up to 30% of benefits not paid...I want the insurance companys license revoked or suspended per MN statute 176.194 Subd. 3 clause 7. I am no lawyer but I did stay at a holiday inn last night. Not really.
