Help in IOWA
my husband has worked for the same company for 24 years. He was injured on job, and has been nightmare for him since. Doctor released him MMI with permanent lifting restrictions. When returning to work he was disqualified from his job, and was told he would now be paid 14.45, and have to bid on an open job that fits restrictions. he was making 21.00 an hour. I can understand disqualification from job because he could not perform anymore and they need the job filled. BUT CAN THEY LEGALLY CHANGE HIS PAYSCALE???
yes; workers comp law does not give a worker permanent right to a pay scale outside of a particular job/position.
ADA does require that the employer discuss reasonable accommodation to the worker's disability.
if such accommodation is not possible, the employer is not required to find another job or create a job for a worker.
