Injured While on Worker comp
#1
I would like to know if anyone here know what will happen now that I was injured while on worker comp? About a week ago I was coming home from my doctor appointment and a car made a left turn in front of me. I swerved to avoid a head on or T-boning the other car and hit a patch of dirt and my car went airborne.

Just 6 weeks prior I had back surgery. Right after the accident I had a stiff neck and head ache. Several days later I started getting pain in my lower back where I had surgery and my upper back. I went to the ER the next day where they did X-Ray. They said that I had whiplash and the x-ray didn't show anything on my back and that I may need to get an MRI. I am in NJ.

it could be a compensible consequence if your medical appointment was for your work injury.
you will likely need evidence: police report, er records, etc.
you will need your surgeon and work comp doctor's opinion on the intervening injury.

Yes I was returning from my worker comp doctor when the accident happened. So you think that this may still be covered under worker comp?

maybe. I'm not familiar with recent New Jersey case law on the issue but generally many states provide coverage for injuries associated with receiving work comp benefits.
