the limit on fees are different in different states and different lawyer can charge differently up to the cap.
generally the atty fee cap applies to the whole case and the fee would be shared among the different lawyers but rules depend on your state (?)

I would only let an attorney go after you find another one willing to take your case first.(JMHO)

You can always let an attorney go. I am not familiar with attorney fees for your state.

Is this normal for attorney's to request this in your state, money up front?

Check with you state's web page on what and how an attorney can be paid in a work comp case.

In my state of Kansas an attorney can not ask for up front money. Attorneys are paid only at settlement time a percent of settlement.

Hi Scooter,

Think before you make the change. I fired my originally lawyer
because he was to busy with big trial cases and his firm never
got around to filing my SSDI papers or answering my messages and
calls. I researched Google and looked for one of the biggest and most
successful law firms in Manhattan. I decided on Napoli & Berns and
asked them to take over all my cases (workers comp, SSDI, and the
third party case) I even had them file my WTC Zadroga case. I figured
any firm this large that can handle thousands of WTC cases and win
tremendous construction accident cases can surely handle a WC case.
So yesterday I had a hearing before a WC judge and my new lawyer
shows up and it's a young man. I raised the issue that the carrier changed
my benefit type from TTD to TPD and he tells me that's not important.
Okay then I raise the issue of being
denied authorization for a Class 2 narcotic which I have been on and
paid for my the carrier for 6 months and because I didn't have the funds
to pay out of pocket for the prescription 4 days after I end up in an
emergency room with chest tightness and withdrawal symptoms. I want
him to raise the issue and ask the judge to have the carrier pay the
emergency room bill and reinbursement my out of pocket expense for
the prescription. He never raises the issue before the court. I was granted
surgery for cubital surgery and carpal tunnel surgery but without prejudice.
I want him to challenge the fact "without prejudice" and he says that doesn't
matter as long as they'll pay for surgery. I ask are you kicking, I want to get
better but I want to be compensated for my injuries, it's bad enough I only
get a portion of what I made working and now he wants me to let them get
off the hook for the casualty and permenant rating that applies to carpal
tunnel surgery.

So be careful and think, you may end up going from the frying pan
right into the fire. These lawyers don't give a shits about these limited
fees they make off Workers' Comp. But if I call for my WTC case they
will call back in 10 seconds, it's all about the dam money! If you have
a multi-million dollar third party case they will kiss your dam ass in
Macy's window for that 33% fees, but try to get one of these those with no designated father
to call back when your in a emergency room suffering from withdrawals
because he didn't want to fight with the claims adjuster over the law that
they can never suddenly stop a narcotic after 6 months of taking it.
Be careful and do your own research and if the lawyer doesn't want to
raise honest issues you might have to fire 10 of the dogs to find one gentleman
who understands the law and the hardships us injury workers are faced with.

I agree that changing attorney's can be a mistake sometimes. Weigh it out. Review attorney's on line reputation with ratings etc.
