Help! Need Advice for Louisiana Worker's Comp
#1
Is there anyone on the forum that can help me with a Louisiana Worker's Comp. case. My son was injured on a job and needs a complicated back surgery. He has had a previous back surgery for a tethered spinal cord 18 years ago when we found out that he had spinal binfida occulta. He went 18 years without any injuries. He started a new job at the beginning of the year and on his 3rd day at work injured himself. The worker's comp carrier is stating pre-exiting injuries. The dr he is seeing states he has "decompression of L3-4 and 5 and a fusion at L3 through L5 with transverse process, pedicle screw fusion as well potentially an interbody graft at L4-5 if one could be placed and based on his anatomy that may not be technically feasible".

whether it is fair or not depends on the degree of risk of getting more or less from the comp court.
the only ones who can better estimate that are those that have access to the evidence concerning his questionaire responses.
your son needs to contact more work comp attys--possibly going out of his local area.
here are some places to start:

Reminder :
........Each state has their own comp system; POST YOUR STATE to get accurate information. Use the search feature to find information from similar questions.
THANKS FOR POSTING.
