Finally got a court trial date

It has taken 7 months with no benefits paid so far, my court date is 1 month away on the 21st. I'm wondering about back pay and how they determine the amount of weekly benefits. The doctor has me at ttd no treatment or surgery yet. On the comp site in one part it said benefits were capped at 323 per week, but in another part it says it goes off of your normal weekly pay and includes normal overtime. one issue of the trial is compensability. pre trial is over with.

each state has different benefits.
all of them have a maximum rate for TTD-- they're not going to pay warren buffet a million$$ a week if he's off work....

....most states pay a percentage of your pay each week every state is different.be prepared for them to have a Dr that says you can work.I pray you have a good lawyer.Back pay is normally paid in a lump sum minus your lawyers fees in about 30 days.Good luck

Am I allowed to say what the name of my Atty's firm is?
I actually called the comp counselor line in OK and got my court date, this site has actually been more help than my atty.
When I went and seen my employers doctor, after reading the MRI and all medical papers, asked if I had filed for disability yet, and at the deposition, the employer's atty also asked if I had filed for disability yet. I believe that at least 2 of the shoulder cuff tears are over 18 months old and one is definitely non-repairable, but I don't understand exactly what that has to do with disability. I really appreciate your responses and input, it's more than I can get out of my atty. Thank you.

here is information on Temporary Total disability including the maximum rates:

you can change your atty at any time. there will only be a single shared fee.

they might be referring to social security disability.
