My lawyer and I recently put in for a final settlement and the employer would not sign it so workers comp denied my final settlement application. My lawyer called me and I went and met with him and he told me that there was nothing we can do if they don't sign. I just find it hard to believe that if they don't sign it I can't get a final settlement, there has to be some limit to where if they dont sign that workers comp will take over and determine my final settlement amount. It cant be that easy for them to just not sign and that is it. That doesnt even sound legal to me. I hope someone can help me with this.

you will get any future benefits: permanent partial, wage loss, medical-- just not a lump sum buy out.
generally the BWC will issue an award of future benefits.
your claim remains active and services will continue

Nope they don't have to settle. They may have to pay you for some things like medical treatment or PPD or what ever but they don't have to settle

I already had surgery, and I was paid from workers comp for a year, and I already received the partial settlement a while ago. I was wanting to settle the claim.

settle for what? "settlement" is not a benefit.
a settlement is only for available benefits; if they have already been paid out there is nothing to settle. they don't have to settle if they want to pay them out as the come due.
they are not going to pay twice for wage loss, medical or impairment.
