Can I really be only 50% disabled?

I am so glad your hearing went well.

Your attorney sounds like a real jerk....and as I wrote above the best kind of attorney to have.

You should consult with an attorney over legal issues. In California, if you cannot get an attorney you can consult with an I&A officer.

Thanks, I hope your first hearing goes as well as mine
did the other day. Even though, all the issues I raised were
not challenged by the insurance company lawyer and agreed
with the judge, I still have to go to another IME for an
examination of the hand and right leg before surgery can
be approved. They tried to say I never raised the issue of
the hand and right knee and their report only shows the
back, left knee and elbow to which I have already had an
IME report. Lucky I had the hospital records with me at the
hearing, (I went and got them personally from the hospital).
My lawyer didn't have them and I spoke up and told the
judge I had them. I find the one mention in the records that
briefly mentioned I complained of pain in the hand and right
knee. The judge looked at it and handed it to the insurance
company lawyer and that at least covered the fact to help cover
their argument of non casually related. So I have to go for
another IME for the hand and right knee. I probably get a
negative IME report because these doctors are for the insurance
company and always seem to have a different opinion then
your orthopedic surgeon. I will probably be denied surgery for
the hand and knee and will have to have another hearing. It's all
part of the game they play, deny, deny, deny!!! As long as your
MRI's and EMG's show the evidence of your injuries the IME's
opinion doesn't hold much merit and you will be approved for
surgery. I know it's so frustrating and for your sake it works out
you don't have to wait to long. I'll say a pray for you and hope

One thing from your last post don't always think that just because an MRI or EMG shows something that you will get surgery. It all depends on what the doctors say. Both sides will have reports and maybe even depo's from the doctors and if it still in question the hearing officer will look at it all and decide what needs to be done. He might order them to go a head with surgery and he might side with the employer and deny it. It is all in the medical evidence. It can be hard to say which way it will go sometimes
